In a major blow to the National Association of Realtors and major real estatefranchisors, hundreds of thousands of homesellers can ask to be reimbursed for morethan $1 billion in commissions they paid to buyer agents in the past eight years as aresult of a federal court ruling on Friday.
The National Association of Realtors and real estate holding company Realogy onMonday both signaled plans to appeal the ruling.
Just days after hearing oral arguments, Judge Stephen R. Bough of the U.S. DistrictCourt in Western Missouri granted class certification in one of two federal commissionslawsuits that could rock the real estate industry and impact how agents arecompensated nationwide.
In 2019, homeseller plaintiffs Joshua Sitzer and Amy Winger filed a lawsuit againstNAR, Realogy, RE/MAX, Keller Williams, and HomeServices of America and itssubsidiaries BHH Affiliates and HSF Affiliates alleging the sharing of commissionsbetween listing and buyer brokers violates the Sherman Antitrust Act by inflating sellercosts.
Other plaintiffs, including Scott and Ronda Burnett, later joined the case.The Sitzer/Burnett suit, like a bigger federal case in Illinois brought by homesellerChristopher Moehrl, seeks to have homebuyers pay their broker directly, rather thanhaving listing brokers pay buyer brokers from what the seller pays the listing broker.
A week ago, the court held oral arguments on the plaintiffs’ motion seeking to have theSitzer/Burnett suit certified as a class action and Bough rendered his decision Friday.
“Plaintiffs argue that class certification is the superior method because each memberhas little incentive to control the litigation because the identical claims would result inuniform damages calculation, each class members’ damages will be small comparedwith the relatively high costs of bringing litigation, separate proceedings would produceduplicative efforts and risk inconsistent verdicts, and class action is the superior methodof adjudication because of the size of the case and issues involved,” Bough wrote in hisApril 22 order.
“ he Court agrees with Plaintiffs that a class action is the superior method for fairlyand efficiently adjudicating the controversy.”
The order means that the Sitzer/Burnett suit now represents sellers who paid a brokercommission in connection with the sale of residential real estate in Missouri listed onone of four MLSs — MARIS, Heartland MLS, Southern Missouri MLS, and the ColumbiaBoard of Realtors MLS — from April 29, 2014 to the present.
NAR’s Response
In an emailed statement, NAR spokesperson Mantill Williams told Inman the 1.5-millionmember trade group will look to a higher court to reverse the ruling.“We are disappointed in the decision and plan to appeal,” Williams said.
Referring to multiple listing services, he said,”The pro-competitive, pro-consumer localbroker marketplaces serve the best interests of buyers and sellers. Local brokermarketplaces ensure equity, transparency, and market-driven pricing options for thebenefit of home buyers and sellers. These marketplaces reduce transaction costs byensuring, among other things, that a buyer broker and their client understand how muchthe listing broker will pay the buyer broker for procuring a buyer for the listed property.
“Local broker marketplaces also level the playing field among brokerages, allowingsmall brokerages to compete with large ones, and provide for unprecedentedcompetition among brokers, including different service and pricing models.”
In an unscheduled public filing Monday, Realogy informed its shareholders that it tooplanned to appeal the judge’s order, but stressed the uncertainty of the case’s outcome.“The Company intends to promptly petition the United States Court of Appeals for theEighth Circuit to pursue an interlocutory appeal of the decision on class certification, butthere is no assurance such appeal will be granted or result in a stay of the proceedings,”the company told investors.
“The Company disputes the plaintiffs’ allegations against it in the antitrust litigation,believes that it has meritorious defenses, and will vigorously defend these actions.Litigation is inherently unpredictable and subject to substantial uncertainties andunfavorable resolutions could occur. Adverse developments or outcomes in current orfuture litigation, in particular pending antitrust litigation, may materially harm ourbusiness and financial condition.”
In an emailed statement, Keller Williams spokesperson Darryl Frost told Inman thecompany was aware of the ruling, but declined to say whether the company wouldappeal.
“The court did not decide the merits of the plaintiffs’ claims, which we categoricallydeny,” he said. “The case is far from over, and we will continue to vigorously defendourselves in court.”
RE/MAX, HomeServices of America and its subsidiaries BHH Affiliates and HSFAffiliates declined to comment.The NAR rules they’re fighting over According to the judge’s order, the plaintiffs allege that the enforcement of certain NAR rules results in price-fixing that artificially inflates residential real estate broker commissions homesellers pay because sellers would not pay buyer brokers withoutthose rules.
One of those rules is a NAR policy, sometimes known as the buyer broker commissionrule, that requires listing brokers to offer a blanket, unilateral offer of compensation tobuyer brokers in order to submit a listing to a Realtor-affiliated multiple listing service.The rule prohibits MLSs from publishing listings that don’t include an offer of compensation that is either a percentage of the list price or a definite dollar amount and can’t be a general invitation to discuss terms and conditions of possible cooperation.
According to Bough, this rule is “the cornerstone of Plaintiffs’ alleged price-fixingconspiracy” and adds, “Plaintiffs contend this Challenged Rule requires every seller tomake a non-negotiable offer of buyer broker compensation.”
The second rule is Standard of Practice 16-15 in NAR’s Code of Ethics, which statesthat “In cooperative transactions Realtors shall compensate cooperating Realtors” —another rule the plaintiffs contend requires sellers to offer compensation to the buyerbroker.
The third rule is the code’s Standard of Practice 16-16, which states: “Realtors, actingas subagents or buyer/tenant representatives or brokers, shall not use the terms of anoffer to purchase/lease to attempt to modify the listing broker’s offer of compensation tosubagents or buyer/tenant representatives or brokers nor make the submission of anexecuted offer to purchase/lease contingent on the listing broker’s agreement to modifythe offer of compensation.” The plaintiffs allege this rule hinders consumers’ ability tonegotiate buyer broker compensation.
The fourth rule is the code’s Standard of Practice 3-2, which says: “Any change incompensation offered for cooperative services must be communicated to the otherRealtor prior to the time that Realtor submits an offer to purchase/lease the property.After a Realtor has submitted an offer to purchase or lease property, the listing brokermay not attempt to unilaterally modify the offered compensation with respect to thatcooperative transaction.” The plaintiffs allege this rule inflates commissions “byeliminating opportunities” for consumers to be able to negotiate the buyer brokercommission.
According to the plaintiffs, the real estate franchisor defendants require each of theirfranchisees, subsidiaries, brokers, and agents to abide by the four rules.“For example, Plaintiffs point to various Policies and Procedures Manuals andFranchise Disclosure Documents of the Corporate Defendants which requirecompliance with the NAR Code of Ethics and either require or strongly encourage NARand local MLS membership,” Bough wrote.
“Plaintiffs argue enforcement of the Challenged Rules is important to the CorporateDefendants because most of their profits are derived from broker commission rates. Forexample, approximately ‘80% of Realogy’s revenue’ in 2017 came from commissions.Plaintiffs also allege Corporate Defendants provide sales scripts to their brokers andagents with canned responses to prevent sellers from deviating from the standard offerof buyer broker compensation.”
The plaintiffs have specifically called out Keller Williams’ training scripts for allegedlyencouraging steering and discouraging sellers from reducing buyer brokercommissions. At oral arguments last week, one of the plaintiffs’ lawyers also revealedthat the plaintiffs are alleging that KW co-founder Gary Keller heads the allegedconspiracy.
Why the judge granted class certification
In order for a case to qualify for class-action status, it must satisfy four elements underthe law: 1. The class is so numerous that it would be impossible to bring them all beforethe court, 2. There are questions of law or fact common to the class, 3. The claims ordefenses of the named plaintiffs are typical of the claims or defenses of the class as awhole, and 4. The named plaintiffs will fairly and adequately protect the interests of theunnamed class members.
According to Bough, the defendants did not dispute that the plaintiffs met thenumerosity requirement, given that “hundreds of thousands of class membersgeographically dispersed throughout the state of Missouri and portions of Kansas andIllinois” would be included.
Bough also agreed with the plaintiffs that there are many questions of law or factcommon to the class, including whether the alleged conspiracy was implemented in theareas in which the subject MLSs operate; whether the alleged conspiracy violates theSherman Antitrust Act; the duration, scope, extent, and effect of the alleged conspiracy;and whether class members are entitled to damages.
He also agreed with the plaintiffs that their claims are typical of all proposed classmembers because they were all subject to the rules at issue, each class member sold ahome through one of the real estate franchisor defendants and listed that home on asubject MLS, each class member paid a buyer broker, and the plaintiffs’ and classmembers’ claims are based on the same legal theories.
“Each class member seeks damages based on the same theory of harm: Defendants’conspiracy to implement and enforce the Challenged Rules caused home sellers to paya buyer broker commission, or at least a fixed, inflated commission, that they would nothave otherwise paid as a condition of listing their market on a Subject MLS,” Boughwrote.
The judge also did not buy the defendants’ contention, made during oral arguments,that the plaintiffs are not adequate class representatives because some proposed classmembers would have actually benefited from the rules at issue if they paid less to abuyer broker as sellers than was paid for them when they themselves bought a home.Bough pointed to the testimony of Craig T. Schulman, an economics professor at TexasA&M University and expert for the plaintiffs, who said that in a world without the rules atissue, buyer brokers would be either eliminated or rare.
“Accordingly, in Plaintiffs’ alleged but-for world, all class members would benefit fromremoval of the Challenged Rules even if they did not have to compensate their ownbuyer broker,” Bough wrote.

“A conflict therefore does not exist among the class members. March 15, 2022A public alert has been issued by the USDA’s Food Safety and Inspection Service regarding certain chicken salads sold under the Trader Joe’s label because of possible contamination with hard plastic pieces.
According to the alert, consumers may have ready-to-eat chicken/slaw products in their homes as it has use-by dates that run through March 12.
According to the alert, “The problem was discovered after an FSIS-inspected establishment received notification by their salad dressing supplier that the dressing may contain hard plastic.” The alert stated that the establishment notified FSIS about the problem. FSIS and FDA coordinate on this matter. These products have not been linked to any adverse reactions.
R&G Fine Foods Inc., Northridge, CA is the manufacturer of the chicken salad. The establishment number P-6247 can be found inside the USDA mark for inspection printed on the label. USDA labeling goes through a very specific process and is approved by The USDA’s Food Safety and Inspection Service (FSIS). The product in question was shipped to Arizona, California, Nevada, New Mexico, and Utah.

To determine if they have the chicken salad at home, consumers can refer to the following information: 12-ounce plastic tray packs containing “Trader Joe’s CRUNCHY SAW with Chicken, Crispy Noodles, & Peanut Dressing”, and a use-by date of 03/09/22.
The chicken salad was made on March 3rd, 4th, 5th, and 6th.
“Consumers who purchased these products should not consume them,” the public alert states. According to the alert, these products should be thrown out or returned to their place of purchase.

The truth is more amazing.
Video of an unknown object travelling in excess of 3800 MPH (6700 KPH) was released by the U.S. Department of Defense (DoD) Monday. Both the footage and the testimony of Naval Officer witnesses describe an Unidentified Aerial Phenomena (UAP) with these characteristics:

The DoD statement accompanying the video release explains that two of the videos were taken in 2015 and one in 2004 by U.S. Navy pilots.
The Leaked Video
In 2007, the U.S. Defense Intelligence Agency (DIA) began a top secret, special access program to investigate UFOs named the Advanced Aerospace Threat Identification Program (AATIP).
The Director of the five year, $22 million program was a career intelligence officer named Luis Elizondo. Leading the AATIP, Elizondo again and again found indisputable evidence of what pilots were calling the tic-tac UFO.
The evidence clearly showed a craft that could travel at hypersonic speeds and make maneuvers that would crush a human being. Almost as astounding was the complete lack of visible engines. The craft was observed travelling underwater at twice the speed of our fastest nuclear submarine. The craft played cat-and-mouse games with our most sophisticated fighter jets.
The evidence that alarmed him. This craft was fully capable of interfering with U.S. weapons systems. These superior aircraft were potential threats. Elizondo raised the alarm.
For his effort, he was met by certain individuals within the DoD who were “staunchly opposed to further investigation”. In time, Elizondo became frustrated that people at the highest levels were “underestimating or ignoring these potential threats”.
Embittered by what he described as “bureaucratic challenges and inflexible mindsets” in all levels of the Department, Elizondo resigned…and took with him three top secret videos titled FLIR, GIMBLE, and GOFAST.
The Leak
In 2017, Elizando went to work for To the Stars Academy of Arts and Sciences (TTSA). TTSA was founded in part by Blink-182 guitarist Tom DeLonge who is fascinated by UFOs. Shortly afterwards, TTSA released the now-famous UFO videos.
In 2018 the US Navy confirmed that the video was authentic.
Revolutionary Patents
In April, 2017 the U.S. Navy quietly submitted a patent for “A Craft using an Inertial Mass Reduction Device”. The story told is that the patent examiner initially rejected the application because the claims were too far fetched. The patent was granted only after the Cheif Technology Officer of Naval Aviation wrote a personal letter to the Patent Office.
The inventor listed on the patent is Salvatore Cezar Pais, an aerospace engineer who works at Naval Air Station Pax River in Maryland. Since that first patent, Pais has been awarded four more patents. Currently he and the U.S. Navy hold patents for the following technologies that seem straight out of a science fiction novel:

Down here we don’t just say hi, we hug and kiss each other like we are family even when we aren’t. Our great American melting pot is full of germs and there’s no easier place to spread those germs than New Orleans. Some claim a connection as far back as Mardi Gras.
Economy Closing
As the Covid-19 virus, also known as The Coronavirus, rages across the country and the world many businesses and workers are going to be drastically impacted. All non-essential businesses have been ordered to close their doors to avoid spreading the virus to their clients and this is especially true for restaurants, bars, and other businesses that require social interaction.
I could bore you with statistics about the virus, but seemingly everyone is writing about that. The other side of the story that is just starting to get coverage is how businesses owners and their employees are going to cope with this catastrophe.
What Can Local Business Owners Do?
Realistically, the answer to that question will vary wildly depending on what business they are in and what shutting down truly means for them. When businesses shut down people lock their doors and stay home. That is what they are expected to do in this situation, stay home.
Restaurants are trying to adapt by delivering food, doing pick up orders, or using delivery services to keep some business going but many of their employees will struggle. There are a host of other small businesses that are going to be in dire straits, please support them if you can.
Impacts on Real Estate
For real estate agents and companies our business is selling homes. Our business could not be any more intimate and personal. The impact on how we do things can be tremendous. We go into people’s homes everyday, many of them total strangers, to advise them on how to move. So how do we do business in an era where people are literally being told not to leave their homes?
In the real estate industry, many agents are attempting to adapt by doing “virtual showings” of their listings but at the end of the day that only goes so far.
How many of you would be willing to buy a house that you haven’t even been in? How many sellers are excited about inviting strangers into their homes?
If a house goes under contract, we still have to do inspections, appraisals, and closings. It is impossible to do any of these things without someone else invading your personal space.
After you consider all these things then you have to actually hire total strangers to move you, or do it yourself. Who wants to do that right now?
Support for REALTORS?
Many people will order from a small mom and pop pizza joint while they are quarantined to help support their local businesses. But realistically who is going to buy or sell a house to support their local Realtor?
The Economy
It is inevitable that sour times are coming in our economy, especially the real estate industry. Much like restaurants and their serving staff, many real estate agents aren’t the best planners. Many live month to month getting random seemingly large checks from selling a property followed by two or three months of not selling anything and earning no income at all.
When you couple these facts with no health care benefits or safety net due to being independent contractors you quickly realize many agents will be in dire financial trouble.
How Long Will It Last?
The question is how long will this last? Will people truly stay home for a month and rip the band-aid of this off so to speak so the virus can die down in a month or are we going to continue to spread it throughout the community despite all warnings from virtually every governmental and medical body throughout the world and drag this out to a point where every company struggles to survive.
The only question that matters now is how long this will last. With every day that passes another real estate agent and company feels more strain until they can no longer bear it. I would argue in the real estate world that Realtors will feel this pain more than almost any other industry at a level not seen since the financial crisis of 2008 and possibly worse.

January 28, 2020If you have ever been fishing in the Gulf of Mexico, then you know Yellowfin Tuna fishing is one of the most exciting activities for avid anglers. Imagine being on a boat and fighting a giant fish for over four hours just for it to get off the hook. This is the scenario Steve Hammerschmidt faced as he reeled in the dark with all he had. He would get the fish within about 15 feet of the boat just to feel the snap as the tension released on his line.
Hammerschmidt of Huntington Beach was on a charter fishing boat named Castigo with Captain Sean Sadler. The owner of the boat Larry Jacinto and fishing mate Adam Cargill were also on board. The group got a tip from another boat, the Red Rooster III. They traveled to the reported spot about 30 miles north from Cabo San Lucas (learn more about Cabo San Lucas) to land the approximately 380 pound super cow tuna that got away. After licking their wounds, the group of men would get some rest and head back out the following morning when the sun broke the horizon.
Cargill added another fishing fly to the line and tried again. This time, they would get a hit practically as soon as the line went under the water. Again, the fish would get away. Finally, Cargill added a sardine to the hook and gave the pole to Hammerschmidt to let him try again and the line took off almost as soon as he had it in his hands. The third time would be the charm for Steve as he fought the behemoth for two and a half arduous hours. Finally, the 365-pound fish was in the boat, and the crew was ecstatic.
The massive Yellowfin Tuna would end up being the largest the team had ever caught. It measured 84 inches long and was a whopping 59 inches around. This huge fish is known as a super cow. Tunas are called “cows” when they weigh over 200 pounds. Any reaching 300 pounds are called “super cows”. The largest one ever caught was a humongous 427-pound monster caught on the south side of Cabo San Lucas in 2012.
The Gulf of Mexico is prime fishing real estate with a variety of species to catch, but anglers love the fight the Yellowfin gives. It takes hours to reel in one of these massive football-shaped fish. To catch these monstrous tuna, anglers have to take a charter fishing boat or large vessel out onto deep waters. The deeper the better, and the water has to be between 74 and 82 degrees to find them, most of the time. Tuna like to swim with dolphin and huge schools of fish, so spotting them can be difficult. Finding these fish takes the skill and expertise of a captain and crew who have a network of contacts and the right equipment to get to the prime fishing areas. Hammerschmidt and the crew would take lots of pictures and end up enjoying their fill of fresh ahi with enough to go around after their excursion. [...]

August 27, 2019REALTOR Goes to Jail for leveraging his real estate license to get into homes and steal from high profile victims
Authorities in Los Angeles, California have arrested a Beverly Hills Realtor and an accomplice for participation in an alleged burglary scheme. Realtor Jason Emil Yaselli, age 32, is accused of conspiring with Benjamin Eitan Ackerman, also 32, to rob luxury homes throughout Los Angeles and profit from selling the stolen goods.
Persistence to Jail the Agent
The Los Angeles Police Department initially began investigating the high profile burglaries in September of 2018 and arrested Benjamin Ackerman at that time. However, the district attorney decided not to move forward with the case.
Nevertheless, the investigation continued, ultimately implicating Beverly Hills Realtor Jason Yaselli as well alleged accomplice Ackerman in the theft plot.
According to authorities, the pair would stake out homes by pretending that an impeccably dressed Ackerman was an interested homebuyer, or in some cases, that he was also a real estate agent.
Ackerman and Yaselli are accused of robbing the homes of several high profile victims including singers Usher, Jason Derulo, and Adam Lambert, as well as numerous others.
Police allege the theft ring was active from December 2016 through August 2018. More than two thousand stolen items were found in both the home and storage unit of Benjamin Ackerman.
Once items were stolen, they were sold with a significant portion of the proceeds designated to pay down Yaselli’s credit card debt. Authorities say the men were depositing as much as $20,000 monthly from the thefts.
What Agents Spend Money On
The men are accused of stealing designer clothes, headphones, expensive jewelry, liquor, and art valued at more than half a million dollars from 14 homes.
The security cameras at the targeted homes were often damaged or tampered with, a fact that first made investigators suspect more than one suspect was involved.
Yaselli and Ackerman face several charges for numerous offenses including: 14 residential burglary counts
32 money laundering counts2 identity theft counts2 conspiracy counts.
Make Bond?
Ackerman was released on a one million dollar bond. He made a statement via his attorney proclaiming his innocence and claiming the prosecution released the names of high profile victims to generate publicity.
Yaselli’s bond was set at $1.73 million.
The National Association of Realtors (NAR) released a statement encouraging consumers to take the time to verify the identity of individuals to avoid being targeted by scammers.

Home buyers across the nation are feeling the impact as the government shutdown as it pushes further into the longest Government shutdown in American history. The shutdown began on December 22, 2018, and continues to cause havoc for federal employees and the public alike. Real Estate, generally seen as a major force in the overall economic outlook of the country, is starting to feel the pain too. Where the 2019 real estate trends were more positive, experts feel the effects on the extended government shutdown could be massive. Federal agencies such as the HUD, FHA and the USDA, are severely understaffed and falling behind in the number of loans they can process.
Real Estate Sales Influence the Entire Economy
As proven with the Great Recession, when the real estate industry takes a dive, so does the entire economy. With real estate sales touching many businesses outside of the direct sale of a home, there is a ripple effect in the economy when a home is purchased. There are countless interconnections with the mortgage industry and the federal government.
The government shutdown is causing mortgage rates to drop making it a great market for refinancing and buying a home. The challenge is that, on the other hand, the influx of applications due to the low rates is further overwhelming an already overwhelmed system. Lenders and real estate agents across the country are preparing their clients to expect delayed closings.
Terrible Timing for a Shutdown
In the last quarter of 2018 the US housing market was struggling to regain momentum; however economists were optimistic for 2019 predicting a more stable market – but no one was expecting a prolonged government shutdown. The uncertainty resulting from the shutdown is hitting consumer confidence hard, according to Lawrence Yun, chief economist with the National Association of Realtors.
“For ordinary Americans, the shutdown adds to economic uncertainty about their future,”
Yun says.
“Buying a home is a high-anxiety transaction, and by adding another complexity to it with possible delays in , it hurts the economy and hurts consumers.”
The 2013 government shutdown lasted for 16 days. Until now, that was the longest government shutdown in history. Through it all the Federal Housing Administration (FHA) was able to continue insuring single-family loans.
However the Housing for Urban Development, HUD website states that “with each day the shutdown continues, we can expect an increase in the impacts on potential homeowners, home sellers and the entire housing market.”
“A protracted shutdown could see a decline in home sales, reversing the trend toward a strengthening market we’ve been seeing.”
The Federal Housing Administration will continue to endorse certain loan products however the process could be slowed down as a result of the shutdown. Some specialized products will not be available at all due to a lack of statutory authority needed to originate them.
Whether the shutdown will delay loans in the pipeline from closing will depend on whether other aspects of the government shutdown affect lenders’ ability to verify borrower information and continue processing mortgages.
How The Shutdown is Impacting Buying a Home
The mortgage industry is further impacted by the shutdown with the disruptions of some of the functions the Internal Revenue Service and the U.S. Department of Agriculture have that affect home loans. Even now, with some IRS workers going back to work with promised pay sometime in the future, the system has fallen far behind and delays are inevitable.
Here is the good, the bad and the ugly for home loans.
Fannie Mae, Freddie Mac Loans
Generally, a government shutdown is not going to impact processing home loans at these agencies as they are not government funded. However, to further disrupt the lives of our federal workers these lenders will be unable to get a verbal verification of employment their federal employers causing a loan approval to be denied or delayed.
FHA Loans
Federal Housing Administration (FHA) and U.S. Department of Veterans Affairs (VA) have not historically been impacted by our government shutting down. However, with decreased staff, some borrowers may experience a delay in their closing due to the increasing backlog. VA loans are typically not impacted by a shutdown as VA staff are paid through borrowing fees and not the federal government.
USDA Loans
Although the U.S. Department of Agriculture is temporarily calling back 2,500 workers, they will not be issuing any new USDA Direct Loans or Guaranteed Loans according to their website. Closings for Direct Loans that have already been scheduled are being canceled meaning some homebuyers may have to wait until the shutdown is over to buy their home.
IRS Verification
Transcripts of tax returns (Form 4506-T) are generally required by lenders at the time of or before closing for income verification. The IRS program, called the Income Verification Express Service or IVES, was reinstated in January to allow home buyers to make these requests after it was suspended during the first few weeks of the government shutdown. The IRS said in a statement that lenders may still experience delays in IVES requests as they work through the backlog.
IVES is critical for self-employed borrowers because they don’t have pay stubs or a W-2 wage report. Without the IVES verification, self-employed borrowers will find it difficult to get approved for a mortgage.
The Good News
According to Bankrate.com’s latest survey of the nation’s largest mortgage lenders Mortgage rates fell in the first part of January, and home buyers and homeowners are taking the opportunity to get a lower rate on their home loan and refinance loans.
The benchmark 30-year mortgage rate fell to 4.63 percent, down from 4.68 percent a week ago. That’s the lowest average rate borrowers have seen since April 18, when it hit 4.58 percent. The benchmark rate peaked at over 5 percent in October.

November 14, 2018As the level of world divisiveness grows higher, so does the diversity of causality, with the most recent example being “white men” described as the country’s true terroristic threat. Famously put by CNN’s Don Lemon, “The biggest terror threat in this country is white men”. Apparently white men, by no factors other than race, are everyone’s problem- including their own. People have begun to conflate, abuse, and misunderstand acts of terrorism with other unfortunate circumstances of anger, violence, and mental health.
What is Terrorism again?
Thankfully a simple Google search for “terrorism definition” reveals the most critical element of the definition: “The unlawful use of violence and intimidation, especially against civilians, in the pursuit of political aims”. A “political aim” means with the backing of a certain ideology- a political ideology. This is the part that emphasizes mental illness. It may seem like a leap, but when understanding this motivation it will make more sense.
The Political Aim
Ideologies show up in many forms, but that does not mean each one should be taken any less seriously than the others. Religious ideology has started many wars, and the modern world should not hide from that fact. With the decline of religious ideology and the rise of political ideology there is room for concern. The ideas that make the most sense to someone becomes their belief… and when their beliefs cannot be disproven, it becomes their faith. When faith leads a person into the world, it becomes immensely harder to stop them.
This is a mental illness. It does not mean it is their forever mindset and it as well does not mean that by nature it is either good or bad. It is something that exists and changes and continues and goes back and never ends. It is a struggle. It is life. People have minds of their own but that does not mean everyone is capable of using it for him or herself, only. Outside factors of control and persuasion, whether inadvertent or not, is real and not everyone is strong enough to cope with them alone, if at all. The only way to handle someone’s ideology that differs from yours is to try and best understand their logic and try to poke holds in it without stepping on their toes.
Anger as a new Faith
Daryl Davis, a black man, went into the underbelly of the Ku Klux Klan and did just this. Because of it his outcome has been changing the lives of over 200 KKK members, including members within the highest of rankings. Davis gives a TED talk on this experience and most certainly everyone should view it (click link here).
It seems almost silly to be looking into the so recent past for guidance in today’s struggles but the voices of Dr. King and his fellow Baptist pastors is becoming so thin it is likely to be never heard again, especially if people do not persist in his faiths. Anger and blame runs through the mind of today’s radicals. The Moral Radicals such as Dr. King are lost and the new American Pernicious Radical persists with leaders on every side of the isle, in every color.
Ideology Explained
Ideology has no race, no sex, no gender, nor any human trait. Ideology is the true shape-shifting master. Ignorance is not bliss, nor is it willful blindness. It is an illness of the mind.
Let us assume Mr. Lemon’s ideology is true and white men are the biggest threat in the country. If this statement were true Mr. Lemon knows the problem, however does not understand it (The reason he does not understand it is, if his true belief of this problem lies within their race then all hope is lost for Don). There is a large distinction between knowing and understanding. Put in universal terms, mathematics, to know that 2+2=4 is very different than from understanding the fact that 2+2=4. To understand it means that the equation comprises of individuals collected together, separated into halves then added together once again (another- different- complex way of breaking it down can be proposed as well, that is part of the understanding). If one knows the problem but does not understand it then a proper conclusion cannot be assumed. A child can be told this equation, recite it, and know it to be true simply “because”, but nowhere can the child prove he or she is capable of breaking it down any further because they will not understand it.
Where is the Truth?
“Why?” -this is the critical question and answer in understanding life, the universe, and everything. The more a person asks why something exists, persists, has happened, and repeats the more the person understands. If someone tells you the solution to a problem before they explain how the problem came to fruition then that person knows everything and understands nothing. This is the true terror threat that America faces today, tomorrow, and yesterday. This is nothing new to America or to the world.
Letting His Followers Speak For Him
Mr. Lemon’s followers have come to his side to defend him, “If you look at most mass shootings in America they have been done by white males. While we keep being told it’s Muslims or caravans we should fear because they are all ‘dangerous’. That was the point he was trying to make”. This quote taken from one of his Instagram followers when prompted on a post Mr. Lemon made today (Nov. 9th). Some of his followers have not addressed that Mr. Lemon was trying to make a certain- different- point, but instead believe the point was made exactly clear and no deeper.”
One follower even disagreed with him being (satirically) called a hypocrite. Instead she was proud and happy to find out that a white male was coming to a new (true) revelation, “Thank you for proving Don right in his commentary, and glad you know his words and memorized the truth about it yourself. I hope you learn and find positive things” from this. Again, defending a man who called white men “the biggest terror threat in this country.”
Too Much Power to the People
People have been given a new power over the last few years- True freedom of equal of speech. This power has shown to be too much for some of the largest companies, Twitter, YouTube, Facebook, etc. With the banning of certain individuals they show that they do not want to be responsible for others’ words. Out of fear they react and choose their easiest option- censorship. When giants fall they grab hold to everything, but are too heavy to be stopped.
Terrorism is a mental illness dormant in every person. For some people it is recessive and others it is not. For some it is fatal and for others treatment exists. For most it lives within them doing no harm and having no outside (or inside) side effect. But “the most” of us should not be weary or forgetful but understanding and hopeful, not filled with blame and fear but with eagerness to better a life, for all.

November 2, 2018The Department of Homeland Security (DHS) has released a special summary of the United States’ understanding and stance of the caravan crisis. As of November 1, 2018, the DHS confirms their goal, “is to provide protection to those individuals who qualify for asylum under our laws, Individuals who want jobs or want to reunify with family members in the U.S. aren’t eligible to qualify for asylum.”
“Over 270 individuals along the caravan route have criminal histories”, these histories include- but are not limited to- aggravated assault with a deadly weapon, sexual assault on a child, accounts of armed robbery and assaults on women.”
In this summary, they as well released their official understanding of what is known concerning the criminal background of certain migrants. “Over 270 individuals along the caravan route have criminal histories”, these histories include- but are not limited to- aggravated assault with a deadly weapon, sexual assault on a child, accounts of armed robbery and assaults on women.”
“The Guatemalan Intel Minister said that the caravan is employing tactics to push women and children to the front to act as human shields as the caravan pushes against its military force”. In the summary, it is noted that the Mexican government has warned the U.S. of potential dangers coming from the caravan, one of those dangers being the infiltration of gangs into the caravan. Reports of very violent behavior towards authority and even the prepping of Molotov cocktails have been confirmed.
Troops To Deploy
With thousands leaving their homes, the warnings coming from Mexico and other Central American countries the United States has confirmed in the deployment of troops. The DHS reports, “By November 2, there will be approximately 5,200 deployed to support U.S. Customs and Border Protection (CBP) at the Southwest border as part of Operation Faithful Patriot. This is in addition to the 2,000 National Guardsmen currently deployed for Operation Guardian Support.”
Caravan Soon To Arrive
The estimate reported on when the caravan may arrive at the border is, “between four days and two weeks” (this being measured from October 31st). The DHS addresses the legality of who will be allowed and who will be denied at the border. Aside from the issue of asylum entrance, the DHS states that, “We will not allow a large group of illegal migrants attempt to enter into the United States if they have no lawful right to gain entry.”
The DHS brings special attention to the fact that many of the illegal immigrant cases within the United States have been due to various loopholes within the countries own legal system. “As a result of these loopholes, when illegal alien minors or adults traveling with minors unlawfully enter the United States, rather than being detained and removed, they are released in American communities. Once released, those who have no legal right to stay here are almost never removed”.
According to the DHS, because of these loopholes and the recent learning of them by citizens of other countries is has caused a, “dramatic transformation in the population of those seeking to enter our country legally”. These other countries have expanded to over 20. The DHS reports migrants among the caravan not only to be from Central and South American but as well as, “Somalia, India, Haiti, Afghanistan, and Bangladesh.”

October 22, 2018Mexico’s southern border is currently undergoing an immigration crisis. Migrants seeking solace and refuge from Guatemala, Honduras, El Salvador, and other Central and South American countries are traversing their way North trying to make it to America or at least into Mexico.
Conflicting Reports
Around 3,000 migrants have collectively caravanned to the border, however Time magazine reported that caravan has reached a third of its original size on Saturday when
“its remaining members woke up on a bridge that divides the borders of Guatemala and Mexico and waited to get past a crossing guarded by hundreds of Mexican federal police”.
However, Sunday morning (Oct. 21) Washington Post reports differently, “A migrant caravan whose numbers swelled overnight to an estimated 5,000 people at the Mexico-Guatemala border has resumed its march toward the U.S. frontier”. In the same report they claim, “It’s not immediately clear where the additional travelers materialized from”.
On The Mexican Boarder
The Mexican police have been somewhat successful at blockading the mass, but hundreds of illegals have already crossed through. If the situation worsens, President Trump has commented on the topic with a plan. The National Public Radio (NRP) reported on Friday, “He’s thanked Mexico for its efforts to stop the so-called caravan. He has also said he will close the U.S. border to these migrants”. This threat is preemptive and has not yet needed to be taken into action. The United Nation (U.N) is currently addressing the best way for their intervention to take place.
The United Nations
As of now the U.N. has only made vague statements concerning the individuals and the treatment they should be given with concerns to their human rights. Friday the Washington Post had this to say, “The U.N. special investigator on the human rights of migrants has a message for the Mexican and U.S. governments: Respect the human rights of every person on the caravan heading from Central America and consider each case individually”.
The United Nations has been aware of Central and South American growing immigration crisis for quite a while, though seemingly has not stepped in preventatively. As early as May of 2018 the U.N. reported, “The number of people fleeing violence and persecution from States in Central America, including Guatemala, El Salvador and Honduras, has risen by nearly 60 per cent in the space of just a year, the UN refugee agency (UNHCR) has warned”. To escape and seek shelter from the ongoing rise of homicide and violence in their home countries these immigrants are hoping to find a better place to live instead of relying on their own governments to help them.
The U.N. has known there to be a southbound immigration crisis on the North and South American hands for quite some time. The U.N. has this to report, “Since 2015, more than two million Venezuelans have left their country. Some 250,000 Venezuelans have remained in Ecuador”. From the same report the U.N. confirmed, “In early September, representatives from 12 Latin American nations met in Quito in a first step to devise a harmonized regional response. A second meeting is planned for the end of November, also in the Ecuadorian capital”.
This meeting may come at either the perfect time or precisely too late. Decisions on whether or not the U.N. will support a military intervention is as well on the table, but still remains to be confirmed.

Howard Hanna Real Estate Services is acquiring Allen Tate Companies to create a powerhouse real estate force in the Mid-Atlantic and Eastern United States with 11,000 employees, the companies announced today. This is one of the many changes is brokerages happening.
“We’ve created this new company with us being a partner with the Tate family and with Pat Riley where we are the majority shareholder, but we are a partnership,” Howard “Hoby” Hanna, president of Howard Hanna Real Estate Services told Inman.
Allen Tate Companies, based in Charlotte, North Carolina, was the 10th ranked brokerage in terms of transactions in 2017 on the Real Trends 500, closing 22,273 transaction sides last year. It now joins Howard Hanna, which was ranked third on the same list – behind NRT and HomeServices of America – with 90,468 transactions closed in 2017.
“For us to grow – and we’ve had the ambition to grow regionally and nationally as a company – we feel that this model could be something new that really appeals to well-run independent brokerage firms that the ownership still wants to stay engaged and be involved and entrepreneurial as opposed to selling 100 percent out to some of the other consolidates or acquirers,” said Hanna. “We become an option for them to remain as we grow the business.”
In the Carolinas, Allen Tate will keep its name and in the eight other states that Howard Hanna operates, it will continue to operate as Howard Hanna — but they will all be in the same family of companies. With the acquisition, the Howard Hanna family of real estate companies now boasts more than 11,000 agents and employees in 326 offices across nine states.
How Much Did It Cost?
Hanna declined to say how much they paid but said it was in the range of four to six times the yearly earnings before interest, taxes, depreciation and amortization (EBITDA). Hanna told Inman he believes the deal was a fair market valuation for a company that has a great brand, great legacy and whose culture merges well with what his company has done.
“Both companies were started by families and started in the late 1950s, we’ve grown up together in the industry with them and Pat Riley and I are both on the board of Leading Real Estate Companies of the World and our management teams have shared a lot of data over the years, our mortgage companies have shared best practices,” said Hanna. “So we think there’s an incredible synergy between our two companies.”
The Future
After the Allen Tate acquisition, Hanna said the company would like to expand even further. It’s looking not only in the Mid-Atlantic, Midwest and East but now the South.
“I personally believe that there’s a market for like-minded companies to come together,” said Hanna. “We’ve obviously been very inquisitive over the last 15 years and we think this is a new strategy. A lot of times we find somebody that wants to do something and thinks they should merge but they still want to stay in the game and we believe this is a new model for us to do that, to achieve that success.”
He added, “The right opportunities with the right entrepreneurial firms would attract us just about anywhere today.”
Other real estate companies like Compass and Berkshire Hathaway HomeServices have made major headline acquisitions this year, but Hanna told Inman that this isn’t so much a defensive move against these companies, it’s been part of their business plan for the past 15 years.
“We started in Pittsburg and began by doing acquisitions in Cleveland, New York, Michigan and Virginia, that’s been part of our business model,” said Hanna. “I think we put ourselves in a good capital position – we don’t have SoftBank behind us, we’ve got our family and the banks that support us for the measured risk we take – and it’s a time where we think people are looking for a different exit strategy or an opportunity.”
As of today, Hanna claims the company has the leading market share in Ohio, Pennsylvania, North Carolina and New York.
